Terms & Conditions
1. Agreement
1.1 Effective Date: The contract becomes effective on the date the customer’s booking is confirmed in writing (email), provided the 40% deposit has been received by Petrichor Africa Safaris (PAS) and a fully completed, signed booking form is submitted.
1.2 Jurisdiction: This contract is subject to Namibian law, and any legal proceedings shall take place in Windhoek, Namibia.
1.3 Authority: Any person making a reservation guarantees they have the authority to enter this contract on behalf of all persons included in the booking. The booking person is liable for the total amount due.
1.4 Acceptance: By making a reservation and paying the deposit, the customer accepts these T&Cs as a binding part of the contract.
1.5 Availability & Price Changes: All offers are subject to availability. PAS reserves the right to adjust prices due to circumstances beyond its control (e.g., fuel surcharges, taxes, currency fluctuations). Customers will be informed as early as possible.
2. Booking Procedures
2.1 Deposit: A non-refundable deposit of 40% is required to confirm a reservation.
2.2 Final Payment: The remaining balance must be paid no later than 8 weeks before departure.
2.3 Failure to Pay: If the full price is not received within 8 weeks of departure, PAS may cancel the booking and retain all funds already paid.
2.4 Accommodation: Subject to availability; PAS reserves the right to provide alternative accommodation of an equal or higher category.
3. Late Bookings
3.1 Less than 3 Months: For bookings made less than 3 months before departure, the full amount is due immediately.
3.2 Within 7 Days: For bookings within 7 days of departure, PAS may charge a late booking fee and additional communication costs.
3.3 Non-refundable: All late booking payments are immediately due and non-refundable.
4. Payment Terms
4.1 Method: Payments must be made via direct bank transfer (details provided at confirmation).
4.2 Currency: Payment must be in the currency stated on the invoice.
4.3 Fees: All bank charges and exchange rate losses are the customer's responsibility.
4.4 Credit Cards: A 3% fee applies to all credit card payments.
4.5 Confirmation: Proof of payment must be sent to PAS; confirmation only occurs once funds appear on the bank statement.
5. Cancellation Policy
5.1 Notification: Cancellations must be in writing via email and are effective upon receipt by PAS.
5.2 Cancellation Fees:
More than 8 weeks before departure: 40% of the total price
Up to 8 weeks before departure: 80% of the total price
Less than 30 days before departure: 100% of the total price
5.3 No-Show: No refunds are given for no-shows or unused services.
6. Itinerary Changes
PAS reserves the right to modify or cancel tours due to weather, flight delays, overbooking, or force majeure. Any resulting additional costs are the customer's responsibility.
7. No Refunds
PAS provides no refunds for any reason, including lost services. The customer indemnifies PAS from all claims.
8. Rescheduling
Moving a booking to an earlier date is subject to availability. Moving to a later date may incur cancellation fees as per Clause 5.2.
9. Deviations
Any costs resulting from a customer's deviation from the planned itinerary are borne by the customer.
10. Unplanned Extensions
Costs for extensions caused by factors outside PAS's control (e.g., strikes, weather) are borne by the customer.
11. Liability
PAS is not liable for loss, damage, injury, death, or delays. PAS acts only as an agent for service providers and is not liable for their errors.
12. Documentation
Customers are responsible for passports, visas, and vaccinations. Comprehensive travel and cancellation insurance is strongly recommended.
13. Health & Safety
Customers confirm they are fit to travel. Medical advice for malaria areas is recommended. PAS is not responsible for health issues during the trip.
14. Airlines & Charters
PAS acts only as an intermediary; the contract is directly between the customer and the carrier.
15. Group Authority
Customers must follow the tour leader's instructions and local laws. Misconduct may lead to exclusion from the trip at the customer's expense.
Declaration
By making a payment to PAS, I confirm that I have read, understood, and accepted PAS’s Terms and Conditions. I understand that I am required to take out adequate insurance for my participation in the trip. I indemnify PAS, its employees, and partners from any liability and acknowledge that I participate in the trip at my own risk.
